Aggressive & Abusive Behaviour – Should you automatically dismiss?

Can an employer dismiss an employee who is aggressive and abusive to a manager?

You can but be aware of the risks. Employers must check if the employee has any kind of disability as this may well have influenced the employee’s behaviour.

Failure to acknowledge a known disability, seek medical advice, follow ACAS advice or even your own contractual disciplinary procedures will leave a business facing a substantial claim for disability discrimination.

A business must determine the cause of the incident, review and update any policies relating to disabled employees and their disciplinary and grievance procedures.

Health & Safety Inspections – Are your health & safety policies up to date?

Did you know that a Labour Force survey found 40,000 workers suffering from musculoskeletal disorder (MSD). As a result, HSE will be carrying out 1,000 inspections within the next two months

Failure to have in place proper health & safety procedures, including risk assessments, could lead to an HSE inspection and possibly civil actions brought about by employees.

You must review your health & safety policies and make employees aware of what is expected by both employers and employees in terms of these policies.
